For more than 30 years, Winning Associates has written tailored employee handbooks for smaller companies in almost every conceivable industry (from the Children's Television Workshop to a five-person firm). These handbooks cost between $2,500 and $14,500. Now, taking the basic and most important policies, we have designed the $400 Bulletproof Employee Handbook.

What Can You Possibly Get for $400? More than enough to communicate the basic policies and benefits to your employees. The policies are listed in the "Copyright Licensing Agreement" below. At the very least, this manual will save you that much in the time you'd spend organizing the materials for a company-generated employee handbook.

The Bulletproof Employee Handbook is between 34 and 40 pages depending upon the size and type of company (see below). As presented, the policies do what they are supposed to do. Significantly modifying and expanding them can change their non-contractual nature and can also invalidate their compliance with federal and state codes.

Some of these policies can be found in abbreviated form in the book Labor Pains. However, as we trust those who have bought the book have noted, those policies remain copyrighted.

Yes, There Is Work That the Buyer Must Do. You must still go through the handbook and change the amount of vacation and sick leave accrual, health insurance benefits, and the like, but you do not have to reorganize the policies. With some smaller companies, it shouldn't take more than an hour to have a "ready to go" handbook. We do not proof the handbooks after you've finished editing without additional charges.

Exceptions? Yes, there are some exceptions. First, the $400 fee is for companies with fewer than 50 employees except California. Second, the cost is $450 for California companies with fewer than 50 employees. For companies with more than 50 employees, the cost rises to $450 ($550 in California) primarily because of the Family Medical Leave Act, FMLA forms, and industry regulations. And last, the handbook is not sold to human resources consulting companies, HR software firms, or labor law firms.

Additional states? No problem. Depending upon which states, Winning Associates charges approximately $150 per state for manuals which must comply with more than one state's labor code.

Updates: Laws and labor codes change. It will be the buyer's responsibility to keep the manual up to date. However, you can check on major changes to labor codes if you are a subscriber to ewin.com. If you want us to make specific changes or to update the handbook for you, we will charge at our normal hourly rate of $385. If you would like us to tailor the handbook for you, our standard rate will be charged less $400 for the purchase of the handbook.

Not A Product; Not Software; What is It? Strictly speaking, The Bulletproof Employee Handbook is a service. Because we take pertinent information from you, such as the size of the company, the type of company, and which state the company has offices, plants, or facilities in, we cannot (and would not) simply use a template for generating a handbook for you. Rather, we do spend time in deciding which policies are absolutely necessary or required, which policies might prove of value to you, and which policies to omit because they are not in your best interests to use. We also make decisions as to alternate policies which are included at the end of every handbook. Yes, we do start with a template for companies with more than or less than 50 employees, but from there, we spend at least a couple of hours generating, not a tailored handbook, but certainly one that will be easier for you to implement once you have made the changes that only you can make.

We do highly recommend - even push - your purchase of the latest edition of Labor Pains, a book which will answer many of your questions as to why policies are written the way they are and why some are necessary and some are detrimental to the company, depending upon its size and management acumen. COPYRIGHT LICENSING AGREEMENT

This document constitutes an agreement and understanding between _____________________, "the Buyer," and E. A. Winning Associates, Inc., Walnut Creek, California regarding the licensing of the copyright to the Bulletproof Employee Handbook ("the manual").

The manual includes the following policies: at-will disclaimer, general "welcome to" policy, harassment and EEO, I-9 eligibility for employment, interviews and background checks, hours of work, attendance, the introductory period, corporate ethics (for banks), confidentiality and conflict of interest statements, acceptance of gifts, performance, moonlighting, access to company premises, access to personnel files, employee status, paychecks and paydays, overtime, payroll deductions, holidays, vacations, sick leave and/or well pay, maternity leave, other leaves of absence, insurance benefits, rules of conduct, disciplinary actions and grievance procedures, resignations and terminations, hiring of relatives, ADA and EOE, personal calls and mail, email and Internet use, smoking, drug abuse and alcoholism, company property, travel expense, dress code, and an employee acknowledgment form. (California handbooks include seven other policies required by labor code or law including the new Paid Family Leave which affects all employers in the state). DC, Massachusetts, and New York handbooks include three to six additional policies.)

Buyer understands that any substantive changes made by the Buyer should be submitted to corporate counsel or Winning Associates (which is not a law firm) for an audit. Substantive changes are not the responsibility of Winning Associates, Inc.

Winning Associates provides one copy of the manual sent via email. It is the Buyer's obligation to make changes and index the manual as the Buyer sees fit. If desired by the Buyer, Winning Associates will provide assistance at an additional hourly consulting fee.

Buyer understands that the fee for the manual is not refundable.

Buyer affirms that it is not an HR consulting, HR software firm, or labor law firm, and that Winning Associates' copyright mark will remain on the manual for the period that the manual is in use. Buyer may not, under any circumstances, give or sell the manual in any form to any other organization, individual, or entity without prior approval of Winning Associates.
